Confused by License Terms/Media Server
« on: June 11, 2002, 10:26:54 am »

Jim H.,

Trying to install MJ on a second computer to start using Media Server.

1.  A sentence ("J. RIVER grants you the right to use one copy of the J. RIVER software program (SOFTWARE) on a single computer.") of your license restricts users to installing one copy of "the JRiver Software Program"  (which program is that?  MJ?  Media Server?  Some other JRiver Software Program?)

2. The first sentence also restricts the end user to installing one copy on a single computer?  That would mean that you cannot install on two computers, which makes running media server very difficult.

Normally, an embedded license for this type of software would restrict the end user from installing THE copy of the software downloaded with the license in more than one computer and thereby leave the end user free to install another copy of the software in another machine.

At some point, isn't installing MJ on more than one machine req'd to get media server to run?

From The License Details

Q: Can I install on more than one PC?
A: During the two-week period after you have purchased or restored, you can use the install key you received to activate the plus features of Media Jukebox on your other PC’s.

King,

I agree the License Details on the MJ website says you can install MJ on more than one computer.  But the license terms that come from y'all with the download (to which you ask end users to click-to-agree) says precisely the opposite:  "J. RIVER grants you the right to use one copy of the J. RIVER software program (SOFTWARE) on a single computer."

Pointing out inconsistencies?  Don't confuse and embarrass us.

What possessed you to read the license agreement in the first place?

The FAQ is more up-to-date and accurate.

No intent to confuse or embarass.  I am just confused by the online license.

I wanted to know whether I could install on a second machine, so I read the online license, which totally confused me.  For example, there is a warranty for the "physical diskette or CD ROM" that one might see in a EULA from the 1980s or early 1990s???  Then, it says that a licensee does not get updates (as opposed to releases); I believe it has been your practice to give licensees updates.  Then it says that "If you make additional copies of the SOFTWARE or the DOCUMENTATION contrary to this Agreement or if the SOFTWARE is installed on additional servers without purchasing the requisite license(s) therefore, then, in addition to any other remedies J. RIVER may have, J. RIVER may require that you immediately make payment to J. RIVER for such copies and/or such use at the then current list price."

Your FAQ makes clear that one can install multiple copies on multiple machines.
Unfortunately, the online license provides that the FAQ has no bearing at all on the online license:

"This Agreement is the entire agreement between J. RIVER and you, supersedes any other agreements or discussions, oral or written, and may not be changed except by written amendment signed by J. RIVER. "

Suggest you go to your FAQ page, provide that the FAQ page amends the end user license that comes with the download, provide in the FAX page that licensees get updates (but not releases) according to the License Detail terms posted on your website, and affix your John Hancock on behalf of JRiver.

Consider our FAQ signed by JRiver.

You're nice to read the license agreement.
