Making the assumption that you mean files with no cover art as opposed to files that had cover art that has somehow gone missing, you can easily re-create the smartlist using the following rule:
[Media Type]=[audio] [Image File]=[]

Nothing changed.

well i don't know when but missing cover art smartlist did not have to be created- it was already there without me doing anything

I've just double checked this for you using a fresh MC build 49 installation and the option to add stock smartlists is there, and it does work as expected. All the stock lists are added to the tree under a 'Smartlists' group as shown in the attached image.

This would suggest that your missing option or smartlist is being caused by something particular to your system, and unless you can work out how to reliably reproduce what you are seeing on other systems, this won't get a whole heap of JRiver attention.

what, exactly, is "not coming up", the option to add stock smartlists, or just that missing artwork smartlist after adding the stock lists?

what i like about JRiver is that there is usually someone prepared to help
